Privacy notice pursuant to Article 13 GDPR (“General Data Protection Regulation”, German: Datenschutz-Grundverordnung) for the Instagram contest “German National Team Jersey and German Football”
The controller responsible for processing your personal data in connection with this contest is the Federal Foreign Office (Auswärtiges Amt), Werderscher Markt 1, 10117 Berlin, represented by the Federal Minister for Foreign Affairs. The contest is carried out by the competent German mission in Canada (Consulate General in Toronto). We process your personal data in order to enable your participation in the Instagram contest “German National Team Jersey and German Football” and to administer the contest. This includes in particular receiving and managing entries, checking that the eligibility requirements are met, randomly selecting and notifying the winner, and handing out the jersey or football. For this purpose, we process your Instagram username and the comment you submit (your answer to the contest question) and – in the event that you win – in addition your name, postal address and, where applicable, further contact details required for handing out the prize. In addition, should you be selected as a winner, we will process your image (photograph) as well as your Instagram username for the purpose of reporting on the Contest and its winner(s) on the official Instagram profile of the Consulate General in Toronto. For this purpose, a photograph of you holding the prize will be taken at the time of the personal prize handover and will be published on the aforementioned profile.
The legal basis for processing your data is Article 6(1)(e) GDPR in conjunction with the statutory tasks of the Federal Foreign Office in the field of public relations and foreign cultural and educational policy. The contest serves to provide information about Germany and about the work of the German mission. If, in the context of the contest, publication of data of the winner (for example the Instagram username) is envisaged, this will only take place on the basis of your prior consent pursuant to Article 6(1)(a) GDPR, which you may withdraw at any time with effect for the future. The taking and publication of a photograph of the winner with the prize on the Consulate General's Instagram profile is based on your consent pursuant to Article 6(1)(a) GDPR; by participating and claiming the prize, you agree to this processing. You may withdraw this consent at any time with future effect; however, in the event of such a withdrawal prior to the handover, the prize cannot be awarded to you.
Your data will only be made available within the Federal Foreign Office and the competent mission abroad to those units that are entrusted with administering the contest (in particular public relations/press office, cultural section and, in individual cases, administrative staff). Data will only be passed on to third parties where this is necessary to carry out the contest (for example to a postal or courier service provider for dispatch of the jersey or football) or where we are under a legal obligation to do so.
Participation in the contest takes place via the Instagram platform. In this context, the platform operator (Meta Platforms, Inc.) also processes personal data, in particular your username, profile information and interactions (likes, comments), under its own responsibility and in accordance with its own terms of use and privacy policy. The Federal Foreign Office has no influence over this processing; please refer to Instagram’s privacy policy for details.
We store participants’ data only for as long as is necessary for administering and completing the contest. Data of participants who do not receive a prize will be deleted no later than two weeks after the contest has ended. Data of the winner will likewise be deleted no later than two weeks after the prize has been dispatched, unless statutory retention obligations require longer storage. The record‑keeping and retention rules of the Federal Foreign Office are decisive in this respect.
The photographs taken during the prize handover will be published on the Consulate General's official Instagram profile for the purpose of reporting on the Contest and its winner(s), and will be stored for the duration of this publication. The storage and public accessibility are based on your consent. You may withdraw this consent at any time with future effect. In the event of a withdrawal, further publication will be terminated without undue delay, and the respective visual material will, as far as technically and legally possible, be removed from the relevant online platforms. Any further storage will then only occur if and to the extent that statutory retention or documentation obligations preclude deletion. This does not affect the possibility that content already further disseminated by third parties or technically processed by platforms may potentially not be fully retrievable
You are neither legally nor contractually obliged to provide your personal data. Participation in the contest is voluntary. However, without providing the data required for participation (in particular your Instagram username and comment and, in the event of winning, your name and address), you cannot take part in the contest and the prize cannot be sent to you.
In connection with the processing of your personal data you have the rights set out in Articles 15 to 21 GDPR. In particular, you have the right to obtain information about the personal data stored about you (Article 15 GDPR), the right to rectification of inaccurate data (Article 16 GDPR), the right to erasure (Article 17 GDPR), the right to restriction of processing (Article 18 GDPR) and – where the conditions are met – the right to data portability (Article 20 GDPR) as well as the right to object to processing (Article 21 GDPR) where processing is based on Article 6(1)(e) GDPR. Where processing is based on your consent, you may withdraw this consent at any time with effect for the future without affecting the lawfulness of processing carried out up to the time of withdrawal.
To exercise your rights you may contact the Federal Foreign Office or the competent German mission abroad directly (contact details as indicated above and on the mission’s website). In addition, you have the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of your habitual residence, your place of work or the place of the alleged infringement (Article 77 GDPR).
There is no automated decision‑making, including profiling, within the meaning of Article 22 GDPR in connection with the contest. The winner is selected using a random procedure (drawing of lots), but this does not involve any evaluation of personal aspects of the data subject in the sense of profiling.
